On November 9, 1970, the Supreme Court refused to hear a challenge regarding the constitutionality of the Vietnam War. The state of Massachusetts took the suit to federal court in defense of state residents who claimed they should not have to serve in an undeclared war. The Court decision against hearing the case was 6-3.
